Woman Sues SeaWorld for Duck-Related Injury

SeaWorld Orlando attracts millions of visitors each year, and many of these people pass through the theme park completely unharmed. However, accidents can always happen at theme parks. Some of these accidents can leave victims with permanent injuries and psychological issues. A recent incident involving a duck allegedly knocked a woman unconscious. What can you do after a theme park accident? Could a Boynton Beach personal injury lawyer help?
Woman Hit in the Face by Duck During Roller Coaster Ride
In late October of 2025, AOL reported that a woman was suing SeaWorld Orlando for an injury she suffered while riding the “Mako” roller coaster. According to the lawsuit, the ride was moving at full speed when an errant duck flew into the face of the plaintiff. This caused her to lose consciousness and suffer other unspecified injuries.
The plaintiff claims that this incident could have been avoided if the theme park had taken more care with the overall maintenance of the roller coaster and the surrounding areas. The plaintiff also alleges that she is permanently disabled as a result of this incident, and that this disability has affected her ability to earn income.
The plaintiff and her counsel allege that this was not a “freak accident.” Although one might assume that a duck flying into the face of a roller coaster rider is a “one-in-a-million” situation, the plaintiff’s counsel argues that a similar incident occurred earlier in the year. This incident involved a child who was allegedly hit in the face by a bird while at the theme park. The child’s injuries were so severe that she required stitches on her forehead. This child also reportedly developed post-traumatic stress disorder (PTSD) and anxiety as a result of her experiences.
If this past incident really occurred, the theme park might struggle to use the “Act of God” defense strategy normally reserved for freak accidents and unforeseeable events. The existence of numerous “bird strikes” could create a duty of care for the park management. If they were aware of numerous bird impacts, one might argue that they should have done more to control the animals and prevent them from hitting guests in the future.
The Mako roller coaster is the fastest ride in Orlando, and it is capable of reaching speeds of 73 miles per hour. It also reaches a height of 200 feet, making it the tallest coaster around. The combination of speed and altitude could arguably make bird strikes more likely and more damaging for guests.
